一、服务条款的确认及接受
I.Confirmation and Acceptance of Service Terms
(一) 京东网站（指北京京东叁佰陆拾度电子商务有限公司及其关联方合法拥有并运营的相关网站及客户端应用程序，以下称“本网站”或“京东平台”或“平台”）各项电子服务的所有权和运作权归属于“京东”所有，本网站提供的服务将完全按照其发布的服务条款和操作规则严格执行。您确认所有服务条款并完成注册程序时，本协议在您与本网站间成立并发生法律效力，同时您成为本网站正式用户。
(I)The ownership and operation rights of various electronic services on the JDwebsite (referring to the relevant websites and client applications legallyowned and operated by Beijing JD 360 E-Commerce Co., Ltd. and its affiliates,hereinafter referred to as "this website" or "JD platform"or "platform") belong to "JD". The services provided bythis website will be strictly implemented in full accordance with the serviceterms and operating rules published by it. When you confirm all service termsand complete the registration procedure, this agreement will be establishedbetween you and this website and take legal effect, and you will become anofficial user of this website.
(二) 京东平台经营者是指经营京东平台的各法律主体，京东可能根据平台业务调整而发生变更或新增，您可随时查看京东平台各网站首页底部公示的证照信息以确定与您履约的京东主体。
(II)JD platform operators refer to the various legal entities operating the JDplatform. JD may change or add new ones according to the platform business adjustments.You can check the license information published at the bottom of the homepageof each JD platform website at any time to determine the JD entity that willperform the contract with you.
(三) 京东平台隐私政策、平台规则、单独协议均为本协议的补充协议，与本协议不可分割且具有同等法律效力。如您使用京东平台服务，视为您同意上述补充协议。
(III)JD Platform Privacy Policy, Platform Rules, and any separate agreements are allsupplementary agreements to this Agreement, which are inseparable from thisAgreement and have the same legal effect. If you use the JD Platform Services,you are deemed to have agreed to the above-mentioned supplementary agreements.
(四) 您在使用本网站某一特定服务时，该服务可能会另有单独的协议、相关业务规则等（以下统称为“单独协议”），您在使用该项服务前请阅读并同意相关的单独协议；您使用前述特定服务，即视为您已阅读并同意接受相关单独协议。
(IV)When you use a specific service on this website, the service may have aseparate agreement, related business rules, etc. (hereinafter collectivelyreferred to as "Separate Agreements"). Please read and agree to therelevant separate agreements before using the service; your use of theaforementioned specific services is deemed to have read and agreed to acceptthe relevant separate agreements.
(五) 根据国家法律法规变化及本网站运营需要，京东有权对本协议条款及相关规则不时地进行修改，修改后的内容一旦依法以任何形式公布在本网站上即生效，并取代此前相关内容，您应不时关注本网站公告、提示信息及协议、规则等相关内容的变动。您知悉并确认，如您不同意更新后的内容，应立即停止使用本网站；如您继续使用本网站，即视为知悉变动内容并同意接受。
(V)According to changes in national laws and regulations and the needs of theoperation of this website, JD has the right to modify the terms of thisAgreement and related rules from time to time. The modified content will beannounced on this website in any form in accordance with the law and replacethe previous related content. (一) 本网站运用自身开发的操作系统通过国际互联网络为用户提供购买商品等服务。使用本网站，您必须：

1、 您可以直接从京东网站上获取京东移动客户端软件，也可以从京东授权的第三方获取，如果您从未经京东授权的第三方获取软件或与京东移动客户端软件名称相同的安装程序，京东无法保证该软件能够正常使用，并对因此给您造成的损失不予负责；
1. Youcan obtain the JD Application directly from the JD website, or from a thirdparty authorized by JD. If you obtain the JD Application or the installationprogram with the same name as the JD mobile client software from a third partynot authorized by JD., JD cannot guarantee that the Application can be usedsuccessfully and will not be responsible for any losses caused to you;
2、 为了改善用户体验、完善服务内容，京东将不断努力开发新的服务，并为您不时提供软件更新，新版本发布后，旧版本的软件可能无法使用，京东不保证旧版本软件继续可用及相应的客户服务，请您随时核对并下载最新版本。
2. Inorder to improve user experience and improve service content, JD will continueto work hard to develop new services and provide you with JD Applicationupdates from time to time. After the new version is released, the old versionof the software may not be available. JD does not guarantee that the oldversion of the JD Application will continue to be available and providecorresponding customer services. Please check and download the latest versionat any time.
三、账户注册、管理及使用
III.Account Registration, Management and Use
(一) 用户资格
(I)User qualifications
您确认，在您开始注册程序使用京东平台服务前，您应当具备中华人民共和国法律规定的与您行为相适应的民事行为能力。若您不具备前述与您行为相适应的民事行为能力，需要在监护人的监护参与下才能注册并使用本网站，您及您的监护人应依照法律规定承担因此而导致的一切后果。
Youconfirm that before you start the registration process to use the JD platformservices, you must have the civil capacity for conduct that is consistent withyour behavior as stipulated by the laws of the People's Republic of China. Ifyou do not have the aforementioned civil capacity for conduct that isconsistent with your behavior, you need to be supervised by your guardian toregister and use this website, and you and your guardian shall bear allconsequences resulting from this in accordance with the law.
此外，您还需确保您不是任何国家、地区或国际组织实施的贸易限制、经济制裁或其他法律法规限制的对象，也未直接或间接为前述对象提供资金、商品或服务，否则您应当停止使用京东平台服务，同时，您理解违反前述要求可能会造成您无法正常注册及使用京东平台服务。
In addition, you must ensurethat you are not subject to trade restrictions, economic sanctions or otherlegal and regulatory restrictions imposed by any country, region orinternational organization, and have not directly or indirectly provided funds,goods or services to the aforementioned objects, otherwise you should stopusing the JD platform services. At the same time, you understand that violatingthe above requirements may cause you to be unable to register and use the JDplatform services successfully.

1、 您按照注册页面提示填写信息、阅读并同意本协议且完成全部注册程序后，您可获得京东平台账户并成为京东平台用户。您设置的京东账号名/昵称/头像等不得违反国家法律法规及京东平台相关规则关于账号注册的管理规定，未经他人许可不得用他人名义（包括但不限于冒用他人姓名、名称、字号、头像等或采取其他足以让人引起混淆的方式）开设账号，不得恶意注册京东账号。否则京东有权拒绝设置或收回您的账号名/昵称。账号名的回收不影响您以邮箱、手机号码登录京东平台并使用京东平台服务。
1. Afteryou fill in the information according to the prompts on the registration page,read and agree to this Agreement and complete all registration procedures, youcan obtain a JD account and become a JD platform user. The JD accountname/nickname/avatar you set shall not violate the PRC laws and regulations andthe relevant rules of the JD platform regarding the management of accountregistration. You shall not open an account in the name of others (includingbut not limited to impersonating others' names, titles, font sizes, avatars,etc. or taking other methods that are confusing) without the permission ofothers, and you shall not maliciously register a JD account. Otherwise, JD hasthe right to refuse to set or collect your account name/nickname. Thecollection of the account name does not affect your ability to log in to the JDplatform with your email or mobile phone number and use the JD platformservices.
2、 京东平台原则上只允许每位用户使用一个京东平台账户。如有证据证明或京东根据京东平台规则判断您存在不当注册或不当使用多个京东平台账户的情形，京东平台可采取冻结或关闭账户、取消订单、拒绝提供服务等措施，如给京东平台及相关方造成损失的，您还应承担赔偿责任。
2. Inprinciple, the JD platform only allows each user to use one JD account. Ifthere is evidence or JD determines that you have improperly registered orimproperly used multiple JD accounts according to the JD platform rules, the JDplatform may take measures such as freezing or closing accounts, cancelingorders, and refusing to provide services. If you cause losses to the JDplatform and related parties, you shall also bear the liability forcompensation.
3、 在使用京东平台服务时，您应当按京东平台页面的提示准确完整地提供您的信息（包括您的姓名及电子邮件地址、联系电话、联系地址等），以便京东或其他服务方与您联系。您了解并同意，您有义务保持您提供信息的真实性及有效性。
3.When using the JD platform services, you should provide your information(including your name and email address, contact number, contact address, etc.)accurately and completely according to the prompts on the JD platform page sothat JD or other service providers could reach out to you successfully. (三) 账户登录

您有权使用您设置或确认的京东用户名、手机号码（以下简称“账户名称”）及您设置的密码（账户名称及密码合称“账户”）或通过授权使用您合法拥有的第三方软件或平台用户账号（如微信账号、QQ账号等）登录京东平台，但第三方软件或平台对此有限制或禁止的除外。当您以前述已有账号登录使用的，同样适用本协议中的相关条款。
You have the right to log in tothe JD platform using the JD user name, mobile phone number (hereinafterreferred to as "Account Name") and password (Account Name andPassword are collectively referred to as "Account") that you set orconfirmed, or through authorization to use the third-party software or platformuser account (such as WeChat account, QQ account, etc.) that you legally own,except where the third-party software or platform has restrictions orprohibitions on this. When you log in with the aforementioned existing account,the relevant terms of this Agreement shall also apply.
您理解并同意，除您登录京东平台以外，您还可以使用京东账号登录京东及其关联方或其他合作方提供的其他软件、服务。您以京东账号登录前述服务的，同样应受其他软件、服务实际提供方的用户协议及其他协议条款约束。
You understand and agree thatin addition to logging in to the JD platform, you can also use the JD accountto log in to other software and Applications provided by JD and its affiliatesor other partners. When you log in to the aforementioned software andApplications with the JD account, you shall also be subject to the useragreement and other agreement terms of the actual provider of other softwareand services.
(四) 实名认证
(IV) Real-nameAuthentication
作为京东平台经营者，为使您更好地使用京东平台的各项服务，保障您的账户安全，京东可要求您按照相关法律法规规定完成实名认证。
As the operator of the JDplatform, in order to enable you to better use the various services of the JDplatform and to ensure the security of your account, JD may require you tocomplete real-name authentication in accordance with relevant laws and regulations.
(五) 更新维护
(V) Update and Maintenance
您应当及时更新您提供的信息，在法律有明确规定要求京东作为平台服务提供者必须对部分用户的信息进行核实的情况下，京东将依法不时地对您的信息进行检查核实，您应当配合提供最新、真实、完整、有效的信息。
You shall update theinformation you provide in a timely manner. If the law clearly stipulates thatJD, as a platform service provider, must verify the information of some users,JD will check and verify your information from time to time in accordance withthe law, and you shall cooperate to provide the latest, true, complete andvalid information.
如京东按您最后一次提供的信息与您联系未果、您未按京东的要求及时提供信息、您提供的信息存在明显不实或行政司法机关核实您提供的信息无效的，您将承担因此对您自身、他人及京东造成的全部损失与不利后果。京东可向您发出询问或要求整改的通知，并要求您进行重新认证，直至中止、终止对您提供部分或全部京东平台服务，京东对此不承担责任。
If JD fails to contact you according to the informationyou provided last time, you fail to provide information in a timely manner asrequired by JD, the information you provided is obviously untrue, or theadministrative and judicial authorities verify that the information youprovided is invalid, you will bear all losses and adverse consequences causedto yourself, others and JD. JD may issue you a notice of inquiry orrectification, and require you to re-authenticate, until it suspends orterminates the provision of some or all JD platform services to you, and JDshall not be liable for this.
(六) 账户管理

1、 由于您的京东平台账户关联您的个人信息及京东平台商业信息，您的京东平台账户仅限您本人使用，您应对您账户下的所有行为结果负责，不得以任何方式转让，否则京东平台有权追究您的违约责任，且由此产生的责任及后果均由您自行承担。您直接或间接授权第三方使用您京东平台账户或获取您账户项下信息的行为后果亦由您自行承担。如京东根据京东平台规则中约定的违约认定程序及标准判断您京东平台账户的使用可能危及您的账户安全及/或京东平台信息安全的，京东平台可拒绝提供相应服务或终止本协议。
1. Sinceyour JD account is associated with your personal information and JD Platformbusiness information, your JD account is for your personal use only. Youshall be responsible for all the results of your actions under your account andshall not transfer it in any way. Otherwise, JD Platform has the right topursue your breach of contract liability, and you shall bear all theresponsibilities and consequences arising therefrom. You shall also bear theconsequences of your direct or indirect authorization of a third party to useyour JD Platform account or obtain information under your account. If JDPlatform determines that the use of your JD Platform account may endanger thesecurity of your account and/or the security of JD Platform informationaccording to the breach of contract identification procedures and standardsstipulated in the JD Platform Rules, JD Platform may refuse to provide thecorresponding services or terminate this Agreement.
2、 您的账户为您自行设置并由您保管，京东任何时候均不会主动要求您提供您的账户密码。因此，建议您务必保管好您的账户，并确保您在每个上网时段结束时退出登录并以正确步骤离开京东平台。
2. Youraccount is set up and kept by you. JD will not request you to provide youraccount and password at any time. Therefore, it is recommended that you keepyour account safe and ensure that you log out and leave the JD Platform in thecorrect steps at the end of each online session.
3、 账户因您主动泄露或因您遭受他人攻击、诈骗等行为导致的损失及后果，京东并不承担责任，您应通过司法、行政等救济途径向侵权行为人追偿。如发现任何未经授权使用您账户登录京东平台或其他可能导致您账户遭窃、遗失的情况，建议您立即通知京东，您理解京东对您的任何请求采取行动均需要合理时间，且京东应您请求而采取的行动可能无法避免或阻止侵害后果的形成或扩大，除京东存在法定过错外，京东不承担责任。
3. JD does not assume any responsibility forthe losses and consequences caused by your active disclosure of the account ordue to attacks, fraud, etc. by others. You should seek compensation from theinfringer through judicial, administrative and other relief channels. Ifyou find any unauthorized use of your account to log in to the JD platform orother situations that may cause your account to be stolen or lost, it isrecommended that you notify JD immediately. You understand that it will take a reasonable time for JD to take actionon any request you make, and the actions taken by JD at your request may not beable to avoid or prevent the formation or expansion of the consequences ofinfringement. JD will not be liable unless there is a statutory fault on thepart of JD.
4、 您理解并同意，为充分使用账号资源，如您在注册后未及时进行初次登录使用或连续12个月未登录任一京东平台，且不存在未到期的有效业务的，京东有权收回您的账号，您可能无法通过您此前持有的账号登录京东平台，您该账号下任何个性化设置（如头像/昵称）即将无法恢复。在收回您的账号之前，京东将以适当方式做出提示，如您在收到相关提示后一定期限内仍未登录、使用账号，京东将收回账号。
4. Youunderstand and agree that in order to make full use of account resources, ifyou do not log in for the first time in time after registration or have notlogged in to any JD platform for 12 consecutive months, and there is no validbusiness that has not expired, JD has the right to collect your account. Youmay not be able to log in to the JD platform through your previous account, andany personalized settings under your account (such as avatar/nickname) will beunable to be restored. Before recovering your account, JD will make a prompt inan appropriate manner. If you still do not log in or use your account within acertain period after receiving the relevant prompt, JD will collect youraccount.
(七) 账号注销
(VII) Accountcancellation
如您需要终止使用京东账号服务，符合以下条件的，您可以申请注销您的账号：（1）您仅能申请注销您本人的账号，并依照《京东账号注销须知》进行注销；（2）您仍应对您在注销账号前使用京东账号服务期间的行为承担责任。特别提示您，您申请同意注销账户的，视为您放弃账户信息以及该账户在平台的资产、虚拟权益等，且京东无法为您恢复前述服务。这可能对您主张售后服务带来不便。
If you need to terminatethe use of JD account services, you can apply to cancel your account if thefollowing conditions are met: (1) You can only apply to cancel your own accountand cancel it in accordance with the "JD Account CancellationNotice"; (2) You shall still be responsible for your behavior during theperiod of using JD.com account services before the cancellation of youraccount. Please be reminded that if you apply to agree to cancel your account,it will be deemed that you have given up your account information and theassets, virtual rights, etc. of the account on the JD platform, and JD will notbe able to restore the aforementioned services for you. This may causeinconvenience to your claim for after-sales service.

您有权在京东平台上享受商品及/或服务的浏览、收藏、购买与评价、配送和交付、平台活动、交易争议处理、信息交流及分享等服务，详情您可登录京东平台查看。
You have the right toenjoy the browsing, collection, purchase and evaluation, distribution anddelivery, platform events, transaction dispute resolution, information exchangeand sharing of goods and/or services on the JD platform. You can log in to theJD platform for details.
(一) 商品及/或服务的浏览、收藏
(I) Browsingand collection of goods and/or services
在您浏览我们网站或客户端的过程中，京东为您提供了信息分类、关键词检索、筛选、收藏及关注等功能，以更好地匹配您的需求。您可以对您感兴趣的商品及/或服务进行收藏、添加至购物车，关注您所感兴趣的店铺/品牌等。
When you browse ourwebsite or the Application, JD provides you with information classification,keyword search, screening, collection and following functions to better matchyour needs. You can collect and add goods and/or services that you areinterested in to your shopping cart, and follow the stores/brands that you areinterested in.
(二) 商品及/或服务的购买与评价
(II)Purchase and evaluation of goods and/or services
1、 当您在京东平台购买商品及/或服务时，请您仔细确认所购商品的名称、价格、数量、型号、规格、尺寸、联系地址、电话、收货人等信息。收货人与您本人不一致的，收货人的行为和意思表示视为您的行为和意思表示，您应对收货人的行为及意思表示的法律后果承担连带责任。
1.When you purchase goods and/or services on the JD platform, please carefullyconfirm the name, price, quantity, model, specification, size, contact address,telephone number, consignee and other information. If the consignee is you, theconsignee's behavior and intention shall be deemed as your behavior andintention, and you shall bear joint and several liability for the legalconsequences of the consignee's behavior and intention.
2、 您的购买行为应当符合法律规定，为生活消费需要购买、使用商品或者接受服务，不得存在对商品及/或服务实施恶意购买、恶意维权等扰乱京东平台正常交易秩序的行为。基于维护京东平台交易秩序及交易安全的需要，京东发现上述情形时可主动执行包括但不限于暂停或停止服务、取消订单等京东认为有必要的管控措施（详见：违规订单处理规则https://help.jd.com/user/issue/399-1183.html）及作出账户处置（详见：违规京东账号处理规则https://help.jd.com/user/issue/164-3445.html）等操作。
2. Yourpurchase behavior should comply with legal provisions. You should purchase, usegoods or receive services for daily consumption needs. You are prohibited fromengaging in malicious purchases of goods and/or services, malicious rightsprotection, or other behaviors that disrupt the normal trading order of the JDplatform. Based on the need to maintain the transaction order and transactionsecurity of the JD platform, JD may take the initiative to implement controlmeasures that JD deems necessary, including but not limited to suspending orstopping services, canceling orders (see: Rules for handling illegal ordershttps://help.jd.com/user/issue/399-1183.html) and account disposal (see: Rulesfor handling illegal JD accounts https://help.jd.com/user/issue/164-3445.html), etc., when discovering the above circumstances.
3、 您理解并同意：本网站上销售商展示的商品和价格等信息仅仅是要约邀请，您下单时须填写您希望购买的商品数量、价款及支付方式、收货人、联系方式、收货地址（合同履行地点）、合同履行方式等内容；系统生成的订单信息是计算机信息系统根据您填写的内容自动生成的数据，仅是您向销售商发出的合同要约；销售商收到您的订单信息后，只有在销售商将您在订单中订购的商品从仓库实际直接向您发出时（以商品出库为标志），方视为您与销售商之间就实际直接向您发出的商品建立了合同关系；如果您在一份订单里订购了多种商品并且销售商只给您发出了部分商品时，您与销售商之间仅就实际直接向您发出的商品建立了合同关系，只有在销售商实际直接向您发出了订单中订购的其他商品时，您和销售商之间就订单中其他已实际直接向您发出的商品才成立合同关系；对于电子书、数字音乐、在线手机充值等数字化商品，您下单并支付货款后合同即成立。当您作为消费者为生活消费需要下单并支付货款的情况下，您货款支付成功后即视为您与销售商之间就已支付货款部分的订单建立了合同关系。
3.You understand and agree that the information on products and prices listed bysellers on this website is only an invitation to offer. When you place an order and payfor goods as a consumer for daily consumption needs, you are deemed to haveestablished a contractual relationship with the seller for the order for whichthe payment has been paid after the payment is successfully made.
4、 尽管销售商做出最大的努力，但由于市场变化及各种以合理商业努力难以控制因素的影响，本网站无法避免您提交的订单信息中的商品出现缺货、价格标示错误等情况；如您下单所购买的商品出现以上情况，您有权取消订单，销售商亦有权自行取消订单，若您已经付款，则为您办理退款。
4.Despite the seller's best efforts, due to market changes and various factorsthat are difficult to control with reasonable commercial efforts, this websitecannot avoid the situation where the goods in the order you submitted are outof stock, with wrong price, etc.; if the goods you ordered are in the abovesituation, you have the right to cancel the order, and so does the seller. 5、 您有权在京东平台提供的评价系统中对与您达成交易的其他用户商品及/或服务进行评价。您应当理解，您在京东平台的评价信息是公开的，如您不愿意在评价信息中向公众披露您的身份信息，您有权选择通过匿名形式发表评价内容。

3、 为适应电子商务发展和满足海量用户对高效优质服务的需求，您理解并同意，京东可在京东平台规则中约定违约认定的程序和标准。如：京东可依据您的登录信息、用户数据与海量用户数据的关系及普通人的正常消费、交易习惯、快递物流行业习惯、生活常识等因素来认定您是否构成违约；您有义务对您的数据异常现象进行充分举证和合理解释，否则将被认定为违约。

如果京东发现或收到他人举报投诉您违反本协议约定或存在任何恶意行为的，京东有权不经通知随时对相关内容进行删除、屏蔽，并视行为情节对违规账号处以包括但不限于警告、限制或禁止使用部分或全部功能。
If JD.com discovers or receives reports fromothers that you have violated the provisions of this Agreement or havecommitted any malicious acts, JD has the right to delete or block the relevantcontent at any time without notice, and impose penalties on the offendingaccount, including but not limited to warnings, restrictions or prohibitions onthe use of some or all functions, depending on the circumstances of thebehavior.
您在京东平台上实施的行为，或虽未在京东平台上实施但对京东平台及其用户产生影响的行为构成违约的，京东可依据相应规则对您中止向您提供部分或全部服务、划扣违约金等处理措施。如您的行为构成根本违约的，京东可关闭、注销您的账户，终止向您提供服务（详见违规行为规则https://help.jd.com/user/issue/32-1199.html）。
If your actions on the JD platform, or actionsthat have not been implemented on the JD platform but have an impact on the JDplatform and its users constitute a breach of contract, JDmay take measures including but not limited to suspending the provision of someor all services to you, deducting losses and liquidated damages, etc. inaccordance with the relevant rules. If your actions constitute a fundamentalbreach of contract, in addition to the aforementioned relevant measures, JD mayclose or cancel your account and terminate the service to you (see the rulesfor violationshttps://help.jd.com/user/issue/32-1199.html for details).
京东有权对您上述违约行为处理措施信息以及其他经国家行政或司法机关生效法律文书确认的违法信息在京东平台上予以公示。
JDhas the right to publicize the above-mentioned measures for handling yourbreach of contract and other illegal information confirmed by effective legaldocuments of national administrative or judicial authorities on the JDplatform.
(三) 赔偿责任
(iii)Liability
如您的行为使京东及/或其关联公司遭受损失（包括自身的直接经济损失、商誉损失及对外支付的赔偿金、和解款、律师费、诉讼费等间接经济损失），您应赔偿京东及/或其关联公司的上述全部损失。如您的行为使京东及/或其关联公司遭受第三人主张权利，京东及/或其关联公司可在对第三人承担金钱给付等义务后就全部损失向您追偿。
Ifyour behavior causes JD and/or its affiliates to suffer losses (includingdirect economic losses, loss of goodwill and indirect economic losses such ascompensation, settlement, attorney fees, litigation fees, etc. paid to externalparties), you shall compensate JD and/or its affiliates for all of the abovelosses. If your behavior exposes JD and/or its affiliates to suffer claims froma third party, JD and/or its affiliates may seek compensation from you for alllosses after assuming obligations such as monetary payments to the third party.

1. When you meet the accountcancellation conditions announced by JD Platform, you cancel your account throughthe website;

出现以下情况时，京东可以本协议约定通知您终止本协议：
In the following circumstances, JD may notifyyou to terminate this Agreement in accordance with the provisions of thisAgreement:
1、 您违反本协议约定，京东依据违约条款终止本协议的；
1. You violate the provisions of thisAgreement and JD terminates this Agreement in accordance with the breach of contract clause;
2、 您盗用他人账户、发布违禁信息、骗取他人财物、扰乱市场秩序、采取不正当手段谋利等行为，京东依据京东平台规则对您的账户予以关闭的；
2. You steal other people's accounts,publish prohibited information, defraud other people's property, disrupt themarket order, and take unfair means to make profits, etc., JD closes youraccount in accordance with the JD platform rules;
3、 除上述情形外，因您多次违反京东平台规则相关规定且情节严重，京东依据京东平台规则对您的账户予以关闭的；
3. Inaddition to the above circumstances, JD closes your account in accordance withthe JD platform rules for your repeatedly violation of the relevant provisionsof the JD platform rules and the circumstances are serious;
4、 其它应当终止服务的情况。

本协议终止后，京东仍享有下列权利：
Afterthe termination of this agreement, JD still enjoys the following rights:
1、 依照法律规定保留平台应当留存的相关信息；
1. Retainrelevant information that the platform should retain in accordance with legalprovisions;
2、 对于您过往的违约行为，京东仍可依据本协议向您追究违约责任。
2. For your past breach of contract,JD can still pursue the responsibility of breach of contract from you in accordance with this Agreement.
3、本协议终止后，对于您在本协议存续期间产生的交易订单，京东可通知交易相对方并根据交易相对方的意愿决定是否关闭该等交易订单；如交易相对方要求继续履行的，则您应当就该等交易订单继续履行本协议及交易订单的约定，并承担因此产生的任何损失或增加的任何费用。
3. After the termination of thisagreement, for the transaction orders generated by you during the survival ofthis agreement, JD may notify the counterparty and decide whether to close suchtransaction orders according to the counterparty's wishes; if the counterpartyrequests to continue to fulfill, you shall continue to perform the provisionsof this agreement and the transaction orders for such transaction orders, andbear any losses or increased expenses incurred thereby.
九、所有权及知识产权
IX.Ownership and Intellectual Property
(一) 您一旦接受本协议，对于您提供、上传、创作、发布在本网站的文字、评论、图片、照片、视频、音频等任何形式的信息内容（包括但不限于客户评价、客户咨询、各类话题文章等），您免费授予京东及其关联公司至保护期终止为止、不可撤销的、全球范围的、排他的许可使用著作权（包括并不限于：复制权、发行权、出租权、展览权、表演权、放映权、广播权、信息网络传播权、摄制权、改编权、翻译权、汇编权以及应当由著作权人享有的其他可许可使用的权利）、肖像权、用户ID名称等相关的全部合法权利权益，就京东具有诉讼主体资格的权利、权益，京东有权以自身名义对第三方侵权行为取证及提起诉讼。您同意京东及其关联公司有权存储、使用、复制、修订、编辑、发布、展示、翻译、分发、推广、出版、发行、信息网络传播您以上信息内容，有权改编制作派生作品，并以已知或日后开发的形式、媒体或技术将上述信息纳入其它作品内。
Once youaccept this Agreement, you grant JD and its affiliates free of charge anirrevocable, worldwide, exclusive license to use the copyright (including butnot limited to: the right of reproduction, distribution, rental, exhibition,performance, screening, broadcasting, information network dissemination,filming, adaptation, translation, compilation and other permissible rights thatshould be enjoyed by the copyright owner), portrait rights, user ID names andother related legal rights and interests for any form of information contentsuch as text, comments, images, photos, videos, audio, etc. (including but notlimited to customer evaluations, customer consultations, various topicarticles, etc.) that you provide, upload, create and publish on this websiteuntil the end of the protection period. JD has the right to collect evidenceand file lawsuits against third parties for infringement in its own name. Youagree that JD and its affiliates have the right to store, use, reproduce,modify, edit, publish, display, translate, distribute, promote, publish,distribute, information network transmission of the content of your aboveinformation, and the right to adapt and create derivative works, andincorporate the above information into other works in the form, media, ortechnology that is known or developed in the future.
(二) 京东有权再许可给其他第三方第九条第一款的所有权利。

(III) Youshall ensure that all information and content in Article IX, Paragraph (I)published on the JD website does not infringe on the portrait, privacy,intellectual property rights or other legal rights of third parties. Otherwise,JD has the right to take measures including but not limited to deletion anddisconnection of links at any time.
(四) 本协议已经构成《中华人民共和国著作权法》第二十六条（条文序号依照2020年修订版《著作权法》确定）及相关法律规定的著作财产权等权利许可使用的书面协议，其效力及于您在本网站上发布的任何受著作权法保护的作品内容，无论该等内容形成于本协议订立前还是本协议订立后。
(IV) ThisAgreement constitutes a written agreement for the licensing of copyright andother rights as stipulated in Article 26 of the Copyright Law of the People'sRepublic of China (the article number is determined in accordance with the 2020revised version of the Copyright Law) and relevant laws, and its effectivenessapplies to any work content protected by copyright law that you post on thiswebsite, regardless of whether such content was created before or after theconclusion of this Agreement.
(五) 您同意并已充分了解本协议的条款，承诺不将已发表于本网站的信息，以任何形式发布或授权其它主体以任何方式使用（包括但不限于在各类网站、媒体上使用）。

十、通知送达
X.Service of notices
(一) 有效地址。您在京东用户账户填写的联系电话、电子邮箱地址、联系地址视为您的有效通知地址。若上述信息发生变更您应当及时进行更新，如果因您提供的联系方式不准确，或不及时告知变更后的联系方式，使相关通知（包括但不限于协议变更、法律文书等）无法送达或未及时送达，由您自行承担可能产生的法律后果。
(I)Valid Address. The contact number, email address, and contact address you fillin your JD user account are deemed as your valid notice address. If the aboveinformation changes, you should update it in a timely manner. If the contactinformation you provide is inaccurate or you fail to inform the changed contactinformation in a timely manner, so that the relevant notice (including but notlimited to agreement changes, legal documents, etc.) cannot be delivered or isnot delivered in time, you shall bear the possible legal consequences.
(二) 通知送达。京东通过上述联系方式向您发出通知，其中以电子的方式发出的书面通知，包括但不限于平台公告，向您提供的联系电话发送手机短信，向您提供的电子邮箱发送电子邮件，向您的京东用户账户发送系统消息以及站内信信息，在发送成功后即视为送达；以纸质载体发出的书面通知，按照提供联系地址交邮后的第五个自然日即视为送达。
(II)Service of notices. JD sends you notices through the above contact information,in which the written notices sent by electronic means, including but notlimited to platform announcements, mobile phone text messages sent to thecontact number you provide, emails sent to the email address you provide,system messages and in-site messages sent to your JD user account, are deemedto be served upon successful delivery. Written notices issued in paper formshall be deemed to have been served on the fifth natural day after they aredeposited in the mail at the contact address provided.
(三) 法律文书的送达。对于与京东有关的任何纠纷，您同意行政、公安、司法等有权机关可以通过手机短信、电子邮件、系统消息或站内信等方式向您送达法律文书，有权机关向上述联系方式发出法律文书即视为送达；若同时采取以上多种方式向您送达法律文书，送达时间以最先送达的为准。您同意上述送达方式适用于行政、仲裁、司法等法定程序的全过程。
(III)Service of legal documents. For any disputes related to JD, you agree that theadministrative, public security, judicial and other authorized authorities mayserve you legal documents through mobile phone text messages, emails, systemmessages or internal messages, and the competent authorities shall be deemed tohave served the legal documents by sending them to the above contactinformation; if the above multiple methods are used to serve you legaldocuments at the same time, the time of service shall be based on the earliestdelivery. You agree that the above delivery methods apply to the entire processof administrative, arbitration, judicial and other legal procedures.
十一、不可抗力或其他免责事由
XI.Force majeure or other exemptions
(一) 您理解并同意，在使用本服务的过程中，可能会遇到不可抗力等风险因素，使本服务协议下的服务发生中断或终止。不可抗力是指不能预见、不能克服并不能避免且对一方或双方造成重大影响的客观事件，包括但不限于信息网络设备维护、信息网络连接故障、电脑、通讯或其他系统的故障、电力故障、罢工、劳动争议、暴乱、起义、骚乱、生产力或生产资料不足、火灾、洪水、风暴、爆炸、战争、政府行为、法律法规变动、司法行政机关的命令、其他不可抗力或第三方的不作为而造成的不能服务或延迟服务等行为。出现上述情况时，京东将努力在第一时间与相关部门配合，及时进行修复，但是由此给您造成的损失，京东在法律允许的范围内免责。
(I)You understand and agree that in the process of using this service, you mayencounter force majeure and other riskfactors, which may cause the service under this service agreement to beinterrupted or terminated. Force majeure refers to objective events that cannotbe foreseen, overcome or avoided and have a significant impact on one or bothparties, including but not limited to information network equipmentmaintenance, information network connection failure, computer, failure ofcomputers or communications or other systems, power failure, strike, labordispute, riot, insurrections, disturbances, insufficient productivity or meansof production, fire, flood, storm, explosion, war, government behavior, changesin laws and regulations, orders of judicial and administrative agencies, otherforce majeure or inaction of third parties that cause failure to provideservices or delays in services. In the event of the above situation, JD will striveto cooperate with relevant departments as soon as possible to make repairs in atimely manner, but JD will be exempted from liability for losses caused to youwithin the scope permitted by law.
(二) 您理解并同意，在法律允许的范围内，京东对以下事由所导致的服务中断或终止不承担责任：
(II)You understand and agree that, to the extent permitted by law, JD shall not beliable for any interruption or termination of service caused by the followingreasons:
1、 受到计算机病毒、木马或其他恶意程序、黑客攻击的破坏；
1.Damage by computer viruses, Trojans orother malicious programs, or hacker attacks;
2、 用户或京东的电脑软件、系统、硬件和通信线路出现故障；
2.Failure of the user's or JD's computer software, system, hardware, andcommunication lines;
3、 用户操作不当；
3.Improper user operation;
4、 用户通过非京东授权的方式使用本服务；
4. User'suse of the service in a manner not authorized by JD.com;
5、 其他京东无法控制或合理预见的情形。
5.Other circumstances beyond the control of JD or reasonably foreseeable.
十二、法律管辖适用及其他
XII.Applicable Laws and Others
(一) 本协议的订立、执行和解释及争议的解决均应适用中国法律。如双方就本协议内容或其执行发生任何争议，双方应尽力友好协商解决；协商不成时，应向协议签订地有管辖权的人民法院提起诉讼。本协议签订地为中华人民共和国北京市大兴区。
(I)The conclusion, execution, interpretation and dispute resolution of thisAgreement shall be subject to Chinese law. If any dispute arises between thetwo parties regarding the content of this Agreement or its execution, the twoparties shall try their best to resolve it through friendly negotiation; if thenegotiation fails, both parties may file a lawsuit with the People's Court withjurisdiction over the place where the Agreement is signed. The place where thisAgreement is signed is Daxing District, Beijing, People's Republic of China.
(二) 如果本协议中任何一条被视为废止、无效或因任何理由不可执行，该条应视为可分的且并不影响任何其余条款的有效性和可执行性。
(II) Ifany clause in this Agreement is deemed to be repealed, invalid or unenforceablefor any reason, the clause shall be deemed to be separable and shall not affectthe validity and enforceability of any other clauses.
(三) 本协议未明示授权的其他权利仍由京东保留，您在行使这些权利时须另外取得京东的书面许可。京东如果未行使前述任何权利，并不构成对该权利的放弃。
(III)Other rights not expressly authorized in this Agreement are still reserved byJD.com, and you must obtain JD.com's written permission when exercising theserights. If JD.com does not exercise any of the aforementioned rights, it doesnot constitute a waiver of such rights.
(四) 本隐私政策以中文和英文书就，如中文和英文内容不一致，以中文版为准。
This Privacy Policy is written in both Chineseand English. In case of any inconsistency between the Chinese and Englishversions, the Chinese version shall prevail.
